Nikola Corp. Trevor Milton, the founder of the company, claims that federal prosecutors have denied access to the company’s vehicles and equipment, saying it is essential to his defense against fraudulent charges.

Milton, scheduled to be tried in April, asked the judge on January 14 to allow certain prototypes and other Nicola assets and locations to be inspected and photographed. He said the government and the company rejected his repeated requests.

He said access to evidence was needed to refute Milton’s allegations of misleading investors. Milton has been accused of lying about the success of his debut truck, Nikolawan, and claims that the company designed and manufactured an electric and hydrogen-powered truck called the badger. He also claimed that Nicola produced hydrogen at a low cost and developed the battery and other components themselves.

“Inspecting these items and demonstrating the functionality of the technology goes to the heart of his defense,” Milton’s lawyer said in a court filing.

Milton wants his lawyers and experts to inspect badgers, Nikolawan, UTV prototypes, and hydrogen demonstration stations and media studios. All of these are in the facilities of the Phoenix company.

Milton, who resigned from the company in 2020, was charged in July with a misleading investor about the outlook for electric car makers to raise stock prices. He pleaded not guilty.

Last month, Milton was fair about the fact that his allegations could be considered a criminal and that prosecutors did not show how his comments affected the purchase or sale of Nikola shares. He sought to revoke the proceedings, saying he was not given any notice. Other arguments.
