The dilemma of having two PAN cards? There is a remedy to solve this

Submitting your PAN card to the Income Tax Office is similar to the procedure for correcting and handing over your PAN card.

Depending on the situation, if you own more than one taxpayer number (PAN), you will be caught up in the real dilemma, whether you get it intentionally or accidentally. You may be punished and in some cases criminal punishment.

But don’t panic. The solution to solve the aforementioned dilemma of having two PAN numbers is: But first, let’s recall the various provisions of the Income Tax Act of 1961.

Section 139A

Section 139A of the Income Tax Act of 1961 relates to eligibility criteria for applying for a PAN, such as when an individual needs to estimate a PAN. According to the section above, a person can only own one PAN. According to Article 7 of Section 139A above, “A person who has already been assigned a tax number in the new series must not apply for, obtain or own another tax number.”

Section 272B

According to this section, an income tax officer can impose a fine of Rs 10,000 on a party if the party owns more than one PAN. For a detailed investigation of this section,

# The penalties imposed are optional — it is up to the income tax officer to decide whether or not to impose a fine if a person is found to have two Permanent Account Cards. The criterion for decision-making is to know the true intentions of the person holding the two PAN cards.

# This section further states that defaulters (with two PANs) will be given the opportunity to hear their opinions. The reason is that he may have unintentionally committed a disability in a hurry, to avoid hassle, or for some other unavoidable cause.

For example, NRI comes to India and applies for PAN. In a hurry to respect his promises abroad, he travels abroad again, and when he revisits the Income Tax Department five years later, he reapplies to the PAN.

Another example is: A person was published a PAN 10 years ago. Now he has moved to his new address, but his PAN card shows his old address. In such cases, the address change process can be very complicated and to avoid the hassle, he can apply for a new PAN and must currently have two PANs. The personal intention here is not wrong, but he made a mistake to avoid the error.

However, there are cases where an individual has fraudulently applied for a second PAN. For example, an individual may have intentionally applied for a PAN and obtained a loan when he or she lost credibility. In such cases, he could be a criminal with a fine of 10,000 rupees.

If an individual has two PAN cards, how do I apply for a PAN card delivery?

As stated in the Income Tax Act of 1961, there is a stipulated procedure for submitting one of the two PAN cards to the Income Tax Office. However, in the age of information and communication technology, there are two ways to apply for card delivery. — Online and offline methods.

Column 11 of this form asks you to mention the PAN you want to surrender. A Xerox copy of the aforementioned PAN must also be submitted with the application.

Precautions / Points

1. When making an online application, the officially signed approval and important documents must arrive at the NSDL office within 15 days of submitting the online form within the above time.

2. The PAN correction form is used as a multitasker. This means that you need to be careful when filling out the form as you will make corrections in the PAN, reissue the PAN without making any corrections, and abandon any additional PANs.

3. Income tax authorities may conduct an investigation. So get ready.

4. Simply filling out the online form does not mean that additional PANs will be cancelled. You may need to visit the relevant evaluator to convince him that an additional PAN was accidentally acquired.

5. You need to be prepared to face questions from income tax authorities. Similarly, you may need to persuade the assessor if necessary.
